Kreindler & Kreindler Attorneys Author Chapter in International Comparative Legal Guide's Aviation Law 2025 Guide
March 12, 2025
Kreindler attorneys Justin Green, Erin Applebaum, Evan Katin-Borland and Marc S. Moller – contributed to an expert analysis chapter in the International Comparative Legal Guide’s (ICLG) Aviation Law 2025 publication.
The chapter provides critical insights into aircraft design safety, limitations to the Federal Aviation Administration’s oversight, and the ongoing challenges in aviation certification processes. Drawing on their extensive experience representing victims of aviation disasters, the authors highlight how recent tragedies like the Boeing 737 MAX crashes exposed dangerous flaws in aircraft design and regulatory oversight.
Safety across the broad expanse of the aviation industry depends on three things: designing safe airplanes; safe piloting practices; and effective government oversight of the aircraft manufacturing process and airline flight operations
The Kreindler attorneys also provided a thorough examination of the FAA’s reliance on aircraft manufacturers in the certification process, including the problematic Organization Designation Authorization (ODA) program that allows manufacturers to conduct certification of their own aircraft.
The root causes of airplane crashes are human failure and economics. People make mistakes, and airlines and manufacturers cut corners in the pursuit of profit.
This contribution to ICLG’s Aviation Law 2025, a prestigious global legal reference publication, further solidifies Kreindler & Kreindler’s standing as the world’s preeminent aviation accident law firm. Since its founding in 1950, the firm has represented victims in nearly every major airline disaster case, bringing unmatched expertise to aviation litigation.
