Successful Settlement Against Toyota

Keyless car ignitions have become increasingly popular. However, there are hidden dangers with this system. Today, drivers able to depart from their parked vehicle with their keys even if the engine continues to run. Making matters worse, each year manufacturers are producing quieter automobile engines.

It’s an inexcusable design flaw. Changes will happen, but people are dying while we’re waiting.

Kreindler Partner Noah Kushlefsky Interviewed about Deadly Push Button Ignitions

Apparently, that was the case for a New York City resident who parked her Toyota in her garage. Overnight, the automobile continued to emit carbon monoxide, which seeped into her house causing permanent brain damage to her and killing her boyfriend.

Kreindler partner Noah Kushlefsky sued Toyota on the woman’s behalf, settling for a substantial, but confidential sum.  After at least 13 similar deaths and countless non-fatal injuries, he has also become an advocate for a simple shut-off switch that could prevent these tragedies.

Our firm’s partners are frequently appointed by judges to play a leading role in Mass Tort or Multi-District Litigation with many different plaintiffs.

Kreindler’s New York Law of Torts (Vols. 14-16)

In pursuing product liability cases, Kreindler attorneys work with investigators, engineers, and product safety experts, who may also testify in court. We stay current with relevant case law and consumer product safety regulations. Our focus is proving that the product was defective, that it caused your injury, and that the manufacturer was therefore liable.

Our legal team also incorporates evidence from similar claims against the same manufacturer to show a trend of negligence or related issues. Product liability often centers on a product’s faulty design or a manufacturing defect, leading to malfunction or other danger in the course of normal use. Liability can also be based on inadequate instructions or safety warnings.

A Focus on Representing Those With Permanent or Life-Threatening Injuries and Fatalities

These can be some of the most challenging cases due to the amount of compensation demanded. Representing multiple victims of the same product defect, for example in a class-action suit, can offer substantial advantages in leverage and cost-sharing.

Nation-wide consumer-injury claims can also be complex due to varying laws in each state. Among our priorities is to have the case heard in a court venue that may be sympathetic to the plaintiffs.

Referring Counsel: Let’s Discuss Your Client’s Case

Kreindler regularly partners with attorneys who already have a relationship with the victim or their family. If there is an award we share our fee while allowing referring attorneys to be as involved as is appropriate.

Lawyers unfamiliar with the complex challenges of consumer product injury law may miss key issues, and therefore opportunities to secure and maximize compensation. We have the resources to dig deep and challenge even large international companies in court.
