Deaths and Injuries Could Have Been Avoided —
Bus Accident Investigator/Litigator Responds to Recent Crash in Utah.
January 9, 2007
New York — The fatal bus crash in rural San Juan County, Utah this past Sunday evening raises critical red flags with regard to commercial bus passenger safety. Early evidence points to operational issues which are only strengthened by public statements made by the bus company's president Bruce Neuharth, "that the ill-fated bus was a new vehicle in perfect working order."
Operational errors are not uncommon in bus accidents. Statistically speaking, bus driver negligence plays a role in most accidents in the U.S. Other factors to consider are design and maintenance problems and as well as overall safety standards. A bus traveling at 65 miles an hour, in wet conditions, where a surviving passenger reports the bus operator admitting his eyes were not on the road at the time of the crash is nothing short of shocking.
On January 6, 2008, 9 people were killed and dozens injured when the bus operated by Corporate Transportation 'N Tours, and Arrow Stage Lines subsidiary, crashed while taking a turn at a high rate of speed.
"This is a very unfortunate and avoidable situation, resulting in a senseless loss of life and injuries. A crash like this did not have to happen and should not happen. In that regard and others it is similar to the Greyhound Bus Crash in New York State's Adirondack Mountains, which killed four, on August 28, 2006," says Noah Kushlefsky, Partner with transportation accident law and investigation firm Kreindler & Kreindler LLP, who represents passengers involved in the Greyhound Crash and other bus accidents.
Kushlefsky offers, "While operational issues are the most common in bus accidents, design flaws as well as maintenance and service issues may contribute to the loss of life and compound injuries. After carefully investigating the causes of a crash, we often find that operational factors combine with bus design issues."
