Alaska Airlines Flight 261: The Firm Wins Key Ruling To Obtain Broader Range Of Damages Under Maritime Law

In a May 2001 ruling, the San Francisco Federal Court handling the case issued a key holding that general maritime law was applicable because the disaster occurred at sea on a flight between two Pacific coast ports.

The successful maritime law argument was presented to the Court by partner Steven Pounian.

The application of maritime law will allow all of the families to recover damages for each passenger's conscious pain and suffering and leaves open the potential for punitive damages. The defendants' motion for an immediate appellate review of this decision was subsequently denied.
