Appellate Court Victory: Kreindler Defeats Attempt By Defendant To Avoid Liability For The Electrocution Of A 10-Year Old Boy Playing Near LIRR Tracks.

On September 12, 2006, the New York Appellate Division Second Department agreed with Kreindler and ordered that the Incorporated Village of Lynbrook must face trial and charges of negligence. The case involves the electrocution death of a 10 year old boy on the LIRR tracks adjacent to a piece of property owned by Lynbrook. Kreindler partner David Beekman argued that Lynbrook was responsible for failing to take reasonable measures to prevent foreseeable injury on the adjoining tracks. Children and others regularly used Lynbrook's vacant property adjacent to the tracks as access to and from a nearby park and no measures were taken to prevent the children from going onto the railroad tracks which were easily accessible.
