 Kreindler & Kreindler Trial Win by Gretchen Nelson
After three weeks of trial, a jury in the Alameda County Superior Court returned a $1.8 million verdict in favor of a Connecticut physician whose royalty contract had been terminated by a company that manufactured and sold a shoulder positioner for arthroscopic surgery. In reaching its verdict, the jury found that the company had breached its contract with the physician and further that the company violated a California statute, Civil Code Section 3344, by failing to pay royalties during a period when the company was using the pysician's name to sell the products.
Gretchen Nelson, the senior partner in the firm's Los Angeles office, represented the physician and was the trial lawyer on the case.
