Joseph P. Musacchio

Joseph P. Musacchio joined Kreindler & Kreindler in 2006 upon the opening of our Boston office, bringing with him twenty-four years of experience as a lawyer in tort litigation, including aviation, medical malpractice, product liability claims, industrial accidents, and other complex tort cases involving death or catastrophic injury. He has also represented parties in commercial litigation and employment law, including the representation of individuals in lawsuits asserting unfair and bad faith settlement practices against insurance companies. Mr. Musacchio is recognized in the legal community as an experienced and highly qualified appellate attorney. Over his career, he has briefed and/or presented over thirty-five appeals to the Massachusetts State and Federal appellate courts and other appellate jurisdictions. He holds the highest rating established by Martindale-Hubbell, which is given to lawyers and law firms considered by the legal community to possess Very High to Preeminent Legal Ability and who embrace Very High Professional Standards.

A 1979 Phi Beta Kappa graduate of the University of Massachusetts in Amherst, Mr. Musacchio, in 1982, graduated with honors from Western New England College School of Law in Springfield, Massachusetts. While in law school, Mr. Musacchio was a Lead Articles Editor for the Western New England Law Review and published an article in that journal on the right to a jury trial in complete civil litigation entitled, "A Due Process Limitation on the Seventh Amendment Right to a Jury Trial."

Upon graduation from law school in 1982, Mr. Musacchio served as a Law Clerk to the Justice of the Massachusetts Superior Court. Thereafter, Mr. Musacchio served the Commonwealth for over three years as an Assistant District Attorney in the Middlesex County District Attorney's Office where he was a senior and supervising attorney representing the Commonwealth on numerous criminal appeals before the Massachusetts appellate courts. He also prosecuted both jury and jury-waived criminal trials and taught and lectured extensively on search and seizure law. Upon entering private practice in 1987, Mr. Musacchio joined the Boston litigation firm of Melick, Porter & Shea as an associate and later as a partner. At that firm, he was a senior attorney in the firm's appellate department and litigated insurance coverage disputes and complex commercial disputes. He was also a frequent lecture on tort law and insurance related issues.

In 2000, Mr. Musacchio began to exclusively represent plaintiffs when he joined the law firm Sarrouf, Tarricone & Flemming where he worked closely with Anthony Tarricone litigating catastrophic injury cases. He also acted as the firm's principal appellate counsel involved in asserting plaintiff's rights before the appellate courts and drafting and arguing complex motions before trial judges.

Mr. Musacchio also has served as an Associate Editor of the Massachusetts Law Review, where he published an article in the Law Review on indemnification law entitled "Statutory Limitations on Indemnity Agreements in Construction Contracts: The Meaning and Effect of M.G.L. c. 149, §29C." This article has been cited numerous times by Massachusetts appellate and trial judges when interpreting indemnification clauses in construction contracts. He authored the chapter on the law of contribution and indemnification contained in the MCLE's Massachusetts Tort Manual. He has also written and lectured on summary judgment law and practice and co-authored an MCLE publication on those topics.

Mr. Musacchio is admitted to practice in the Commonwealth of Massachusetts, United States Court of Appeals (First Circuit), United States District Court for the District of Massachusetts, and is a member of the Massachusetts Bar Association and the American Association for Justice.
