Kreindler partner Dan Rose recently secured a significant trial victory on behalf of a Navy Seaman who was tragically killed when the 17 foot training vessel he was riding in was run over by a 600 foot 8 barge flotilla on the James River in Virginia. The complicated and cutting-edge case received significant coverage in legal papers and throughout the tug boat industry. The $1,250,000 award was affirmed by the Fourth Circuit. Mr. Rose together with Kreindler partner Marc Moller also handled a challenging Longshore and Harbor Worker Compensation Act case involving the drowning death of Rocco Morganti, a test engineer who was employed by Lockheed Martin in Cayuga Lake, New York. Even though Lockheed Martin initially relegated the claim to New York State Workers Compensation, Rose was able to convince the Second Circuit Court of Appeals that Morganti should have a jury claim under the LHWCA. Kreindler partners Gretchen Nelson and Dan Rose prosecuted claims against Princess Cruise Lines, a subsidiary of Carnival, on behalf of 31 passengers arising from the listing of the Crown Princess on July 18, 2006 off the coast of Florida.
Our firm also represented 90 foreign nationals in the United States arising out of the sinking of the Sea Diamond near Santorini, Greece in 2007. That sinking bears striking similarities to the recent Costa Concordia tragedy and raises many of the same complex legal issues. Those cases were settled for confidential amounts in the United States.
